PRIVACY POLICY AND NOTICE OF COLLECTION OF PERSONAL INFORMATION

This Privacy Policy sets out the Policy of DownDog India Private Limited (together “we”. “us”, “DownDog”) with respect to the way we obtain, use and disclose information about you including but not limited to, through our website at www.downdog.co.in and different social media platforms.

 

DownDog takes the protection of your personal information seriously.  For the purposes of this Privacy Policy, “Personal Information” is information or an opinion about you as an identified individual or an individual who is reasonably identifiable, whether the information or opinion is true and whether or not it is recorded in a material form.

 

DownDog also treats the personal and health information of each of our employees with absolute confidentiality and strict controls are placed on who has access to such information.  We will not disclose your employee records to any third party as permitted by Law or this Privacy Policy without your prior consent.  If a request is made in writing from a third party and you consent to disclosure, we will only confirm or deny information that they have already received from you.

 

This Privacy Policy applies to only DownDog India Private Limited but not to other companies or organizations DownDog or websites to which DownDog is associated with.  

 

For the sake of clarity, this Privacy Policy covers Personal information collected and used by DownDog in relation to any of the following in India:

 

  1. Our clients or prospective clients – when they register an enquiry, book a class through the online booking form or purchase a DownDog membership.

  2. When we receive enquiries through the website and when the website is otherwise accessed or used.

  3. Suppliers or prospective suppliers – when they are engaged to supply services to us, provide information to us or invoice us for the provision of services.

  4. Independent contractors or any person who applies to become an independent contractor; and

  5. Employees or persons who apply to become an employee, except where the use or disclosure is directly related to the relationship between the employer and you as the past or present employee and relates to an “employee record" about you.

Consent

  1. You consent to your Personal information being used in accordance with this Privacy Policy by any one or more of the following:

  2.  Attending our Yoga Clubs;

  3. Purchasing our goods or services or making enquiries or providing us with your contact details, in each case including via our website, or phone, email, internet, social media or during meetings with us;

  4. Attending our Yoga Clubs;

  5. By providing us with your personal information in relation to entering into a membership agreement with us or otherwise engaging us to provide goods or services, or entering into a competition initiated and managed by DownDog, promotional campaign, making a complaint or for any other reason;

  6. By visiting DownDog website or participating in an online enquiry;

  7. By visiting any website or social media managed by us, including but not limited to Instagram, Youtube, Linkedin, Facebook, Twitter. Pinterest (“Social Media Sites”) or downloading and/or using any online app related to DownDog; and

  8. By participating in any activity on a Social Media site including but not limited to entering competitions, subscribing to our blog, sharing posting, pinning or uploading any material on any Social Media site, following, liking and/or commenting on us or anything on any Social Media site (“Social Media Activity”).

Personal Information details we collect.

The kind of personal information we may collect will depend on who you are (e.g., a client or supplier) and the nature of your interaction with us, and may include but not limited to, your full name. physical billing address, Aadhar card details, Driver’s license details, Passport details, company name, billing information and other personal details. We may also collect billing information such as credit card number and billing address.  If you do not provide us with all the information we request, we may not be able to deliver our services.

 

From our employees and/or prospective employees, we may also collect the following information; commencement dates, employment status, location, gender, Aadhar card details, Drivers License details, Passport details, bank accounts statements, emergency contact details, educational qualifications, previous employment details, car registration number, medical and health information, leave summaries from previous employer, wages and salary detailed information, date of birth, family details, where relevant visa and immigration information, information relating to performance and conduct.

 

From time to time, photos may be taken and used for marketing and promotional purposes which may include images of employees and/or clients, from which individuals may be able to be identified.  As an employee, your photo may be used on our online web presence which includes but not limited to DownDog website, DowDog social media handles and also to promote DownDog service offerings at the club or during our road show outside our club.

 

For our clients our Yoga Teachers might take photos of you during the yoga session or within the Club or during Downdog organized outdoor Yoga session or even at a road show.  But the Yoga Teacher will seek your permission first before taking photos of yourself.  Any photos taken may be used at on DownDog website, social media managed by us or even on our own marketing collateral.

 

Via Social Media sites, we may be able to obtain other information about you which may itself constitute Personal information or which, when combined with other information, can identify you, including photos, videos and any other information that you include on DownDog Social Media sites or sites linked to our Social Media sites (“other sites”).  Th level of information to which we have access may depend on your privacy settings on such other sites.

 

In some circumstance, you may deal with us anonymously or using a pseudonym.  However, in most circumstances it is impracticable to do so because if you do not provide us with the Personal Information that we require or if you provide it is a way that does not identify you, we are likely to be unable to carry out the services or supply the goods requested by you.

Channels through which we collect Personal information.

  1. From you when you make a general or specific enquiry online, through an email, by phone call, by walking into our club, participate in a competition organized by DownDog, participate in a promotional campaign, subscribe to our mailing list, participation in social media managed by DownDog.

  2. From you when you provide us with such information to us via DownDog application forms, DownDog client feedback forms, business cards, DownDog membership contracts or any other document provided by you to us.

  3. Through analysis of the social media sites conducted by us or by third parties on our behalf.

  4. From third parties such as credit reporting agencies, recruitment agencies, insurers and insurance brokers, health professionals.

  5. From publicly available sources of information and 

  6. From our own records

How we use your Personal information

We will use Personal Information for purposes that relate to the operation of our business and the provision of DownDog services to you.

 

These purposes generally include but not limited to the following:

 

  1. Supplying DownDog products and services to you.

  2. Customizing our website to the needs of our clients.

  3. Sending periodic newsletter to you.

  4. Managing feedback and complaints.

  5. Communicate with our suppliers.

  6. Launch new services more aligned to your needs.

  7. Enforce our terms and conditions with you.

  8. Address potentially prohibited or illegal activities.

  9. To third parties for the management of our database, software, hardware or web-based systems.

  10. Ensuring compliance with statuary obligations.

 

In relation to the Personal Information of clients, the purposes include the general purposes mentioned above and includes verifying, notifying and/or responding to you in relation to any enquiries, complaints, or if you win a competition organized by DownDog.

 

We use and disclose information we hold about you as an employee, of or incidental to our role as your employer and in accordance with applicable laws.

Cookies

We may use “cookies” technology to store data on your computer using the functionality of your browser. to recognize a user’s browser each time that user visits our site.  Tracking technologies may also be used to deliver personalized content to you while you are visiting our website and to track which pages the user visits whilst on our site and to send DownDog promotions/periodic news to your internet protocol address.  Cookies are pieces of information that a website transfers to a computer’s hard disk for record keeping purposes.  Most web browsers are set to accept tracking technologies such as cookies.  These tracking technologies do not personally identify the user.  If you do not want to receive any cookies, you may set your browser to refuse them.  However, your use of our website may be affected.

Disclosure of your Personal Information

Your Personal Information will be disclosed to us and to third parties as necessary to facilitate any of the above-mentioned purposes.

 

When a product or service is purchased, we may disclose your personal information to the supplier.  We may also disclose personal information to third parties for purposes associated with a purchase and to third party service providers we engage to help us deliver our products and services and for marketing purposes.

 

We will also disclose Personal Information to additional third parties with consent or if permitted or authorized to do so by law.  Some places outside of India may not have adequate data protection laws at all or may offer differing levels of protection of Personal Information.  By submitting Personal Information to us, you acknowledge that, provided we have used your Personal Information in the ways set out in this Privacy Policy, we cannot be held responsible for any use of your data by third parties located overseas who receive and process your data.

 

You do, however, consent to our use and disclosure of your Personal Information in the following ways:

 

  1. To third party consultants who may from time to time manage all or part of our database or computer systems or internet sites.

  2. To a third party where we outsource any of our business process functions, including but not limited to processing online payments, payroll, customers database management and client feedback, IT and cloud storage service provider and processors, sms and email marketing service providers, for the development, production and/or printing of advertising and marketing material and campaigns, including where such material contains photos or videos of individuals.

  3. Of or incidental to a sale of all or part of our business, to prospective purchasers and their legal and accounting representatives.

  4. To the public, for example, via internet when notifying of competition results or via media when photographs or video are used in advertising material or campaigns.

Transfer in certain circumstances

If there is a sale, merger, consolidation, change in control, transfer of substantial assets, reorganization, or liquidation of us then, in our sole discretion, we may transfer, sell, or assign Personal Information collected to one or more relevant third parties.

Access, correction, and complaints

You can request and we will provide you with access to, any Personal Information we hold about you (subject to any applicable legal exceptions).  Please also let us know if you have any concerns or complaints about the way we are handling your Personal Information, so we can address them.

Disclosure of your Personal Information via Social Media sites

We reserve the right to remove any photos, comments or other material that is any way inappropriate or offensive (in our opinion) from our social media sites.

 

By engaging in any Social Media Activity on our Social Media sites, you agree to and are subject to the terms and conditions of such Social Media sites.  Any Personal Information shared, pinned or posted or uploaded by you on or onto Social Media sites can be disclosed in accordance with the terms and conditions and privacy policies of such Social Media sites.

Data Security and quality

We will take reasonable steps to protect the Personal Information we collect and hold from misuse, loss and interference and from unauthorized access and modification, and to make sure it is accurate, complete and up-to-date when we collect, use or disclose it.

 

To assist us, please ensure you provide us with your correct details, and let us know if you believe the information, we have about you is inaccurate, incomplete, out of date or misleading (and we will take reasonable steps to correct the information).  We may take steps to destroy or permanently de-identify information when it is no longer needed for any purpose for which it maybe be used or disclosed.  We may retain and use de-identified information.

Changes in Privacy Policy:

This Privacy Policy forms part of the Agreement between you and us (either in your capacity as a customer or supplier).  We may from time to time, amend this Privacy Policy, in whole or part, in our sole discretion.  Any changes to this Privacy Policy will be effective immediately upon the posting of the revised Privacy Policy on the Website.  Depending upon the nature of the change, we may announce the change on the home page of our Website or by email (if we have your email address).  However, in any event, by continuing to use the Website following any changes, you will be deemed to have agreed to such changes.  If you do not agree with the terms of this Privacy Policy, as amended from time to time, in whole or part, you must terminate your use of the Website.
